Please read these Terms and Conditions ("Agreement", "Terms and Conditions") carefully before using OnBoard Support ("the Service") operated by Ink & Toner Solutions, Inc. d/b/a Northampton Computer Repair ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Service from Northampton Computer Repair (http://www.northamptoncomputerrepair.com). The Service is provided using Solarwinds RMM software, owned & operated by Solarwinds MSP Inc. for data collection and analysis.
By accessing or using the Service in any manner, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

Information Collection and Use
THE ONBOARD SUPPORT SERVICE AND THE ASSOCIATED SOLARWINDS PLATFORM SOFTWARE DOES NOT HAVE THE ABILITY TO VIEW, MODIFY, DELETE, OR STORE ANY DOCUMENTS OR FILES THAT ARE STORED ON THE DEVICE BEING SUPPORTED WITHOUT EXPLICIT OPT-IN BY CLIENT DURING REMOTE SERVICING, NOR DO THEY COLLECT ANY PERSONALLY IDENTIFIABLE INFORMATION BEYOND WHAT IS NEEDED FOR CUSTOMER REGISTRATION AND LINKING OF DEVICE TO AN ACTIVE SUBSCRIPTION AFTER INSTALLATION.
In order to use our Service, we require you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your name, email address, postal or billing address and phone number ("Personal Information"). We also collect other data pertaining to the devices ("Device Information") on which services by us will be performed which may include, but is not limited to, Operating System details, application and process-related extension/plugin/library details, system and application log files, error reports and bugcheck codes, and hardware profiles. None of the aforementioned Device Information is personally identifiable. The security of your Personal Information is of utmost important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security, though we will never knowingly or otherwise release, disclose or sell your Personal Information to any outside party for any reason, except by order of law enforcement or subpoena.
Service Definitions
The Service provided by Ink & Toner Solutions, Inc. dba Northampton Computer Repair on a monthly subscription basis includes (depending on the service level opted for):
- boot & startup process monitoring and optimization
- technician responses to emailed/app-submitted questions
- monitored installation of supported application updates & Operating System updates as needed (Premium & Elite
- anti-virus & firewall status monitoring
- Critical error/system/application crash report interpretation and notification
- hard disk fragmentation monitoring and automatic defragmentation as needed
- low drive storage warnings
- free installation of supported applications (upon request, if compatible)
- remote or On-site Service/maintenance performed by a technician - TECHNICIAN SERVICE PLANS ONLY
- managed endpoint security - AVAILABLE AS ADD-ON TO ANY PLAN
REGARDING RATES AND SERVICE INCLUDED WITH OUR TECHNICIAN SERVICE PLANS: All service to be included with each service plan will be outlined in a Service Level Agreement ("SLA") to be provided to client and signed by both parties. All Service rates that go beyond allotted labor expenses included in the plan's subscription price will be billed at the rates outlined in the personalized provided at sign-up. We will notify you if any service we provide may not be covered by your service subscription prior to performing that service, or if the service requested to be performed is otherwise outside of the scope of the SLA.
REGARDING RATES FOR OUR NON-SERVICE (MONITORING ONLY) PLANS: Additional Premium 1-on-1 Remote Support and Training is also available if needed at the following discounted rates (Discount only available to Premium & Elite Subscribers) :
- Up to 60 minutes of remote support - $29.99
- Remote support requiring 60+ minutes of connected time - Continued at $1/minute
- In-Store Diagnostics - $29.99
Not all services included here can be performed on all devices or platforms due to technical limitations. Services described as "As Needed" are performed at the discretion of Ink & Toner Solutions, Inc.'s qualified technicians or other qualified agents. Additional Premium Remote Support is billed upon completion of service or connection termination, whether initiated by you or the Service's technician. Service technicians may be unable to fully resolve certain issues via remote support (esp. hardware malfunctions) due to limiting factors including, but not limited to needing to be physically in contact with the PC, network connectivity, software or hardware interference, or user interference. By using the Service, you agree to be bound by these terms and conditions and agree to acceptance of the following Disclaimer of Warranties and Limited Liability.

ONBOARD SUPPORT'S RELATED SITE, SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE. WHILE WE MAKE REASONABLE EFFORTS TO ENSURE THAT THE SERVICE WILL FUNCTION AS CLAIMED, WE DO NOT GUARANTEE THAT THE SERVICE OR ASSOCIATED SOFTWARE WILL BE FREE OF BUGS, SECURITY BREACHES, VIRUS ATTACKS AND THE LIKE, OR THAT IT WILL ALWAYS BE AVAILABLE. THE SERVICE WILL OCCASIONALLY BE UNAVAILABLE FOR ROUTINE MAINTENANCE, UPGRADING, OR OTHER REASONS. IN ADDITION, YOU AGREE THAT THE SERVICE AND ITS OPERATORS WILL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES THAT MAY RESULT FROM TECHNICAL PROBLEMS OF THE INTERNET, SLOW CONNECTIONS, TRAFFIC CONGESTION OR OVERLOAD OF OUR OR OTHER SERVERS, ETC.
INK & TONER SOLUTIONS DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE SECURITY OF ANY INFORMATION YOU MAY ENCOUNTER OR ACTIVITIES YOU ENGAGE IN DURING THE COURSE OF YOUR USE OF THE SERVICE.
Further, you agree to hold harmless of any liability Ink & Toner Solutions, Inc., Solarwinds MSP (provider of software), or any of its agents or directors for any reason including, but not limited to, damage, loss of data, or dysfunctionality caused by installation of associated software or services performed thereto for any reason including, but not limited to, improperly installed software, pre-existing conflicting software, unsupported or modified device hardware, or operation of software and service on unsupported, stolen, pirated, counterfeit, or incompatible Operating System.
This section shall survive any termination of these Terms.
Intellectual Property
OnBoard Support is considered software-as-a-service, delivery of said service is through the device of third-party software (Solarwinds). Ink & Toner Solutions, Inc. makes no claim to ownership of any intellectual property, including, but not limited to, copyrights, trademarks, service marks, or logos ("Marks") associated with Solarwinds's software platform. The content provided in the software, including without limitation, the text, documents, descriptions, products, software, graphics, photos, sounds, videos, interactive features, and any other content ("Content") and the trademarks, service marks and logos contained therein, are owned by or licensed to Solarwinds MSP. Content in the software is provided to you “AS IS” for your information and personal use only and may not be used, copied, distributed, transmitted, broadcast, displayed, sold, licensed, de-compiled, or otherwise exploited for any other purposes whatsoever without Solarwinds’ prior written consent. If You download or print a copy of the Content for personal use, You must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security-related features of the software or features that prevent or restrict use or copying of any Content or enforce limitations on use of the software. Solarwinds MSP reserves all rights not expressly granted herein.
“Solarwinds” and the Solarwinds logo are Marks of Solarwinds MSP.
This section shall survive any termination of these Terms.
Termination
We may terminate your access to the Service, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. You may also choose to terminate your access to the Service at any time, and may do so without penalty by uninstalling the OnBoard Support software from your associated device. However, We cannot be held responsible for any recurring Service subscription fees that may continue unless you have specifically notified us of your cancellation or intent to cancel the Service. This notice can be provided to us by phone, in writing, or via email at service@northamptoncomputerrepair.com.

Ink & Toner Solutions, Inc. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Massachusetts, United States of America, without giving effect to any principles of conflicts of law.
Changes To This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms and Conditions.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Service and discontinue any use of the Service immediately.
